A judge acquitted a woman for reckless driving, which led to two deaths.

Niki Chan fell asleep while she was driving on Highway 401 from Montreal to Toronto. This caused the car to slam onto the shoulder, killing Louis Morais and Chan’s father in the process.

Nike Chan was acquitted, because she was unaware of her current underlying sleep disorder. And the prosecution agreed to the 23-year-old’s alibi.

Sleep disorder specialists testified during the trial. One expert diagnosed Niki of having idiopathic hypersomnolence, which causes her to be sleepy.

The expert said that this affected here alertness, reaction times, and awareness.

This was taken to account by the judge and the prosecution, leading to Niki’s acquittal.
