Cephalon sues Watson for generic version of Nuvigil

Last Wednesday, Cephalon Inc. formally announced that it is suing Watson Pharmaceuticals Inc. for developing a generic version of Nuvigil, Cephalon’s sleep disorder drug.

Cephalon has also filed a similar lawsuit against Teva Pharmaceutical Industries Ltd. The two companies will also be disputing over the sleep disorder drug.

In recent years, Cephalon had settled patent disputes with several companies, including Teva and Watson.

The latest lawsuit was triggered by Watson’s Food and Drug Administration (FDA) request for approval on a generic version of Nuvigil. Cephalon’s suit with Watson will trigger a mandatory waiting period to prevent the FDA from approving the generic version of Nuvigil for 30 months, or until the court makes a ruling.
