Cephalon sues Apotex for sleep drug patent | 
Cephalon Inc. is suing Apotex Corp. and Apotex Inc. for copyright infringement of Cephalon’s patent of the sleep disorder drug, Nuvigil.
Cephalon claimed that it has already filed a lawsuit to the US District Court in Delaware after Apotex submitted a generic version of Nuvigil for approval to the Food and Drug Administration (FDA).
By law, the pending lawsuit will delay the FDA’s approval of the sleep drug from Apotex.
